FEDERAL LITIGATION | Cases Pending in U.S. District Court

Jacks v. Warden
The issue in this case is whether the conditions of Stephen Jacks’s confinement at Riker’s Island – being denied access to writing instruments, medical treatment and sufficient access to his attorney – resulted in his entering a guilty plea rather than continuing with a trial.
Mr. Jacks is represented by Sara Gurwitch

Page v. Martuscello
This case, currently pending before the Southern District of New York, raises an ineffective assistance of counsel claim, where counsel intentionally misled client about possible sentence exposure, failed to explain difference between plea offer of 12 years determinate and an indeterminate 25 to life sentence, and failed to properly advise Tyreek Page about whether or not to accept a plea offer.
Mr. Page is represented by Richard M. Greenberg.

Stenson v. Heath

In this case Charles Stenson was convicted of three separate burglaries based solely on the jury's belief that Mr. Stenson was the person seen on three poor-quality surveillance videos. There was no physical evidence. There were no witnesses who identified him as the person on any of the three separate videos. Thus, Mr. Stenson argues that where, with no other evidence submitted except for generic, non-descript clothing worn by Mr. Stenson at an unrelated time, it is impossible to conclude that the person on each of the three videos is the same person, let alone Mr. Stenson, and therefore the evidence cannot be legally sufficient.
Mr. Stenson is represented by Alexandra Keeling.
